Scope of Services

Holmes Logistics Transport provides non-asset based dispatch and logistics coordination services for motor carriers. We act as a dispatch service working on behalf of carriers to source loads, negotiate rates, and coordinate logistics. We do not operate as a freight broker.

Carrier Responsibilities

Carriers are responsible for:

Maintaining valid MC/DOT authority
Maintaining required insurance coverage
Compliance with FMCSA regulations
Safe operation of vehicles
Timely delivery of freight
Proper handling of documentation

Compliance Disclaimer

Holmes Logistics Transport provides dispatch coordination services only. Carriers remain fully responsible for compliance with all federal, state, and local laws, regulations, and safety requirements. We do not provide legal or compliance advice.

Limitation of Liability

Holmes Logistics Transport shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services. We do not guarantee specific rates, load availability, or revenue outcomes.

No Guarantees

We do not guarantee minimum rates per mile, load availability, or any specific revenue outcomes. Market conditions, carrier performance, and other factors beyond our control affect results.

Independent Contractor Relationship

Carriers using our services are independent contractors. Holmes Logistics Transport does not employ drivers or own vehicles. We do not create an employment relationship between dispatchers and carriers.

Payment Terms

Payment terms vary by service agreement. Weekly service fees are billed in advance. Percentage-based fees are calculated on gross revenue from loads booked through our services.

Termination

Either party may terminate service agreements with 7 days written notice. Dispatch services already performed are non-refundable.

Dispute Resolution & Governing Law

These terms shall be governed by the laws of the State of Georgia. Any disputes shall be resolved through binding arbitration in Pearson, GA.
